I haven't reviewed the paperwork, but in my experience many garage blocks are now particularly underused, and those which are used are often used not for parking vehicles, but for storage etc. As I often say on CW4, people need to be aware of the wider planning context, i.e. that national and local planning policies and associated guidance lean towards minimum car parking provision. As for the notification process, the Council is required, for any planning application not in a Conservation Area, to either (1) notify the owner/occupier of any land immediately adjoining the application, or (2) to ensure that a site notice is displayed for the public to see. In reality Councils these days go far beyond the minimum statutory requirements and consult far more widely than they are strictly required to do. As for the tenants of the garages, because the garages form part of the application site it is not the responsibility of the Council to notify them of the application. Nor, unless the tenancy agreement has more than 7 years left to run, does the applicant legally have to notify the tenants that a planning application is being made, although certainly when I am submitting applications for land where there are existing tenants, I would always write to those tenants simply in the interests of good practice/courtesy. |
