Following the recent High Court judgement finding Thames Water liable for causing an odour nuisance from Mogden at various times between 1999 and 2007, more than 1000 families' claims for compensation are being processed by Hugh James Solicitors. The Judge ruled that between 1999 and 2009 Thames Water could have run the works to a higher standard and has awarded damages until 2007. When preparing the litigation it was estimated by experts that approximately 36,000 residents could be affected by nuisance from Mogden. Residents who did not sign up to the Group Litigation may still be entitled to claim compensation for odour and/or nuisance from 2006 onwards on a no win no fee arrangement. The Judge therefore found that until the expansion is complete, an injunction to restrain further odour would not be practical. It is therefore important that victims of continuing odour from Mogden register their interest with Hugh James Solicitors so that further action can be considered after completion of the expansion next year if the odour off site has not been eliminated |
