Well Steve, the official line is this (cut and pasted from one Council's planning committee agenda) : Enforcement Report By virtue of paragraph(s) 6 of Part 1 of Schedule 12A of the Local Government (Access to Information) Act 1985 as amended. Explanation of Reasons By Virtue of Paragraph 6 Information which reveals that the authority proposes - to give under any enactment a notice under or by virtue of which requirements are imposed on a person, or to make an order or direction under any enactment, Condition: Information is exempt to the extent that, in all the circumstances of the case, the public interest in maintaining the exemption outweighs the public interest in disclosing the information. Personally I totally disagree with it and am only aware of this particular Council acting in this manner. I think it's unlikely, but I often wonder if it's because I worked there for a short/unhappy period of time and from time to time afterwards pointed out to ex-colleagues who still worked there flaws in some enforcement reports/recommendations being made to committee, and very soon after the enforcement reports suddenly went from being discussed in public and published on the agenda to being discussed in private and the report not included on the public agenda for anyone to read... |
