Well said Stephen. I was wondering when some of you would start putting your side across! Any chance of posting some illustrations of the proposed ‘low cost’ solution? Martin - just a small point about the offer to buy the riverbed – it cannot [legally] be sold outwith an Act of Parliament, because the Council do not own it – and never have pretended to. Ownership vests, either in the Crown Estates or [arguably] the Lord of the Manor of Ealing [who disclaims all title anyway]. Ownership would not help you in these circumstances anyway; the PLA have the right to licence riverworks regardless of who owns the riverbed, and the riverworks licence there is held by the Council. If you owned the riverbed that would give you only an unassailable defence against an ultra vires claim for trespass over it; it would not convey any rights to the use of the riverworks that enable you to stay there. |
