I was talking more generally, but the fundamental point is the same, and we're not only talking about the Council. I wouldn't have thought a planning consultant acting for a developer, or the developer themselves, want a planning permission that they know could well be quashed in the High Court. Certainly it's not something I'd ever be comfortable with on behalf of one of my clients, and every developer I work with is extremely risk averse when it comes to any possibly of a JR quashing their permission. Working in this field of area everyday of the week for the last 22 years on both sides of the fence, I've never seen any local authority take a dismissive approach to statutory consultation, indeed precisely the opposite. |
