Adam, if anything haven't you kind of made Dan's point for him? On the issue of the mast, as I understand it Three can argue that because it is seen in the national interest to have working 5G network they can build masts where they need to within reason. So they don't have to consult on this application or place a notice in the paper. Let's just assume Hounslow did insist on planning permission being required with a formal consultation process. Is there really any real danger of this being challenged in the High Court because the consultation was inadequate? There are probably only 10-15 properties that would consider themselves significantly negatively affected by the proposal and even combined they may not have the financial resources to force a High Court challenge which would in any case only delay the mast being built not stop it. That means that the Council know their is no risk putting the notice in a paper that nobody in the area has access to because there is no risk of it being challenged. |
