Jim, I'm sure I've had this debate with you and others before when discussing other sites or advertising near roads in particular, and my personal view remains that any driver who is distracted by an advertisement shouldn't be on the road because they aren't capable of driving with due care and attention. To me, the content of the advertisement isn't relevant when discussing whether an advertisement is distracting, you could say that the McDonalds arches shouldn't be visible from any road on the basis that they might distract a fat person !. And Stonehenge should have a huge solid barrier erected around it to prevent drivers on the nearby roads paying more attention to the structure than the road they're driving on !. And taking your logic and chosen image further, none of us should drive around with their other halves in the car (or bit on the side) because we're liable to be distracted by our carnal desires and cause an accident !.
