Personally, I'd always advise trying to approach the legal owner of the land direct before involving the Council. Of course the legal owner may not give a toss and ignore any correspondence you send, but at least you have tried to resolve it amicably before seeking the Council's intervention.
In my view a considerable percentage of matters of this nature that are reported to Councils could be resolved amicably if there was more dialogue between neighbours - neighbourly relations can often be damaged beyond repair when a Enforcement Officer turns up having received a complaint.
One further thought - presumably, as your back gate is accessed via this land, you have a right to cross this land for access to your property as set out in your deeds ?.
