My guess would be that you would have to provide some evidence to suggest that the warden was hatless - perhaps a photo time-stamped around the time the ticket was issued. Without that you probably have to pay up.

If the warden was on his own, chances are it was just too hot for him to wear his full uniform - can't blame him but then again I don't think motorists can be blamed for trying to get off on a technicality given that this is the basis on which councils often issue fines.
