It is the shareholders who have to pay the fines or compensation on legal claims. Its part of OFWAT's job to ensure that legal expenses and fines are not included in AMP. Whether OFWAT actually does this is another story as it is a very weak and ineffective regulator. However this should not deter people and the Local Authorities from hauling Thames Water into court every time they are negligent or flaunt the law. I recall reading that when RWE sold Thames Water to the Australians about £100million was set aside from the sale to cover ongoing and pending legal cases
